Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the services following any changes indicates your acceptance of the new Terms.
Description of Services
Inficod provides custom software development, digital engineering, UI/UX design, and related technical consulting services. The specific scope, deliverables, timelines, and costs of any project will be outlined in a separate Statement of Work (SOW) or Service Agreement signed by both parties.
We retain the right to refuse service, terminate accounts, or cancel projects in our sole discretion if we observe any violation of these Terms.
Intellectual Property Rights
Unless otherwise agreed upon in writing within a specific Service Agreement, all materials, software code, designs, and content created by Inficod during the execution of a project remain the intellectual property of Inficod until full payment has been received.
Upon final payment, intellectual property rights for custom-developed software are typically transferred to the client, excluding any pre-existing open-source libraries or proprietary Inficod frameworks used as foundational elements, which remain licensed rather than sold.
User Obligations
As a client or user of our platforms, you agree to:
- Provide accurate and complete information required for project execution.
- Respond to requests for feedback, approvals, and materials in a timely manner.
- Ensure you have the legal right to use any third-party assets (images, databases, code) you provide to us for inclusion in your project.
- Not use our services for any illegal or unauthorized purpose.
Limitation of Liability
In no event shall Inficod, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the services.
- Any conduct or content of any third party on the services.
- Any content obtained from the services.
- Unauthorized access, use or alteration of your transmissions or content.
